Magistrate Santigie Bangura of Pademba Road Court No.1 yesterday remanded three accused persons- James Augustine Bangura, Jane Bangura and Edmond Kenny Sesay at the Male and Female Correctional Centres on Pademba Road and Jomokenyatta Road in Freetown respectively.
James Augustine Bangura was charged with three counts of wounding with intent, wounding and assault, while Jane Bangura and Edmond Kenny Sesay were charged with one count of assault in a manner occasioning actual bodily harm, contrary to Sections 18 and 20 of the Offences Against the Persons Act of 1861 and section 47 of the same Act.
Police prosecutor, Assistance Superintendent of Police, Mary Joe, alleges that James Augustine Bangura, on Sunday 18th June,2017, at 3 Bass Street, Brookfields in Freetown, wounded Joseph Atanwa, with intent to do him grievous bodily harm, while James Augustine Bangura, Jane Bangura and Edmond Kenny Sesay, on the same date also assaulted the complainant in a manner occasioning actual bodily harm.
Counsel for the defence, Lawyer I.F Sawanneh, made an application on behalf of his clients, stating that they should be granted bail on the grounds that they are residents in Freetown, and that if granted, they would not interfere with the complainant or the prosecution witness or witnesses.
Police prosecutor, A.S.T Joe, objected the bail application on the grounds that the complainant and the accused persons stay at the same compound, and that if bail is granted, there is a possibility for recurrence of the incident.
Magistrate Bangura, however, refused the accused persons bail and remanded them.
“I have also dealt with similar case involving two of the accused persons months ago on two occasions, therefore there is no guaranty that bail would render them any good,” he noted.
Meanwhile, the matter was adjourned to 5th October, 2017.
In another matter before Magistrate Bangura, one Osman Kamara was also remanded for Larceny contrary to section 2 of the larceny Act of 1916.
According to the particulars of offence, the accused, on Tuesday 27th June, 2017, at Wilkinson Road in Freetown, stole one TVS Star H.L.X 125 motor bike valued Le5,620,000 property of Titus Konomany.
Lead in evidence by police sergeant Sellu Tap, first prosecution witness, Titus Konomanny, stated he went to the Sierra Leone Commercial Bank at Wilkinson Road to collect his salary alone with his bike.
He testified that he left his bike in the care of the security guard at the bank, adding that upon his return, he could find the bike.
“After searching for the bike I went up to the manager and reported the matter and he told me to report the matter to the police,” he said.
Counsel for the accused, D.D Baah, made an application on behalf of her client for bail on the grounds that the accused person is a resident in Freetown and if granted bail she will make sure that her client will be in court on the following adjourned date.
Meanwhile, bail was refused and the matter was adjourned to October 10, 2017.
