Justice Alusine Sesay yesterday extolled counsels representing the plaintiff and defendants in the US$365,000 payment claim suit at the Freetown High Court for exhibiting what he described as tolerance in bringing the matter to an amicable settlement.
Lebanese nationals and brothers Bassam Ghoussoub and Rabia Ghoussoub, Directors at MODCON Construction Company, were remanded in prison Wednesday, 12 August, after both parties could not reach an agreement as to payment plan for the debt owed to the plaintiff.
Justice Sesay yesterday said at the Freetown High Court that counsel for the plaintiff, Solomon Segepor Thomas, and for the defendant, Ronald Gidwani, have both exhibited remarkable tolerance between them to settle the matter amicably, unlike some other counsels who would have fought each other over nothing.
In his ruling, following the previous day’s submissions of both lawyers, the Judge of the Appeal Court ordered the defendants to pay the balance debt owed to the plaintiff, plus Le5 million as cost to the plaintiff.
Bassam Ghoussoub and Rabia Ghoussoub owe plaintiff Mohamed Skaikay, a businessman, US$365,000, after the latter supplied them building materials between 2009 to 2013 for the construction of a shopping plaza in Bo, southern Sierra Leone.
The plaintiff claims that a third defendant owes him Le76, 845,848 for building materials he supplied for the construction of the Bo plaza pavement and screen wall.
