10th prosecution witness testifies

The tenth prosecution witness in the murder trial of Mbamba Moiforay aka ‘LA Chocolate’, Foday Amara Kamara and Avril Oredola Renner yesterday testified at the Freetown High Court presided over by Justice Alusine Sesay.
The trio are alleged to have murdered David Sydney Buckle, alias ‘DJ Clef’, at the Aberdeen residence of the first accused, and were charged with two counts of conspiracy to murder and murder contrary to law.
While testifying, Oseh Lebo told the court that on Friday, 22 May, 2015 he attended the birthday party of third accused Ms. Renner at the residence of first accused Moiforay, together with four ladies he only identified by their first names – Sonita, Mummy, Delmah and Kadija.
He said at about 4pm that day the third accused joined them in the preparation of food, while the party started at around 8pm.
He said guests started arriving at around 8pm, although the security officer at the gate did not allow them in until the third accused intervened. He said he saw the deceased and one Claude enter the compound just about when guests were allowed into the compound.
According to the witness, he was asked to serve drinks and that he was busy serving the guests when it started raining, adding that some guests, including the deceased, went inside to escape from the rain.
The witness continued that he, Claude and other guests were swimming in the pool when he was told by the second accused that the first accused wanted to see him at the gym.
He added that after he came out of the pool, he saw one Idriss asking the third accused as to the whereabouts of the deceased, and that the latter responded that the deceased had left
He said Claude then shouted the deceased’s name but there was no answer, adding that they left subsequently even though they could not locate the deceased.
He said on the following day at around 4:30pm, Claude and Idriss went to the residence of the third accused and informed her that the alleged murder victim was still missing.
He said on Saturday afternoon Idriss, Claude and family members of the deceased went to the house of the third accused to enquiry as to his whereabouts of the deceased.
“I then told them that the third accused was not within, but she later showed up and asked as to whether the deceased’s relatives brought police officers to arrest her,” he explained.
He explained that he and the third accused were asked by the deceased’s family to go to the Aberdeen Police Station to make a statement, and that they were detained after police statements were obtained from them.
He said the third accused then contacted the first accused, who was also arrested when he arrived at the station.
The witness further told the court that after three days they were taken to the headquarters of the Criminal Investigation Department in central Freetown and locked up for few days. “I was taken out of the police cell to identify some items but I told them that I only saw the brown vehicle cover.”
