Justice Alhaji Momoh Jah Stevens has on Wednesday (26th May, 2019) convicted and sentenced Mohamed Musa and Mohamed Sesay to Ten years imprisonment each for robbery.
Musa and Sesay were before the court on three counts of conspiracy, robbery and larceny contrary to Section 23(2) of the Larceny Act of 1916.
The prosecution had alleged that the convicts on 10th December, 2018, attacked and robbed the complainant of his property and physical cash, all to the total value of thirty million Leones.
Prior to the sentencing of the convict, State Prosecutor, Janneh B. Kamara, submitted that the charges which the men were stood in court for were very serious offense that warrant a sentencing of life imprisonment.
He asked the judge to slam maximum sentence as recorded in Section 23(2) of the Larceny Act of 1916, which demands life imprisonment for anyone convicted under the said section.
In their plea of mitigation, the convicts pleaded with the judge to temper justice with mercy and that in the end they will be ambassadors in their societies.
In his judgment, Justice Stevens recalled that during the complaint’s evidence in chief, he told the court that both accused forced their way into his house, where the first accused slashed him with a cutlass.
He said PW1 also claimed that his sister sustained injuries during the attack and was rushed to the hospital.
The judge noted that the complainant was able to identify the first accused during the rowdy attacked.
“I hold that the prosecution had proven its case beyond reasonable doubt against the accused persons and I found them guilty on counts 1, 2, and 3. I thereby sentence them to ten years imprisonment each on count one, two and three,” he ruled.
