Mbaimba Moi Foray alias LA Chocolate, Foday Amara Kamara and Avril Oredola Renner have been arraigned at the Freetown High Court presided by Justice Abdulai Charm after Principal State Counsel Monfred M. Sesay filed a miscellaneous application on behalf of the state against the accused persons.
The trio have been subjected to a preliminary investigation at the Freetown Magistrates’ Court No.1 for the offence of murder, with Magistrate Komba Kamanda presiding.
But the prosecutor yesterday informed Magistrate Kamanda that he had filed a miscellaneous application on behalf of the State against the three accused persons before Justice Abdulai Charm to continue the matter at the High Court, thus calling on the magistrate to discharge the trio.
Sesay revealed he did not wish to offer any further evidence before the magistrate against the accused persons, as he urged the latter to discharge the accused persons as they are effectively now in the upper court with the trial commencing on 17 September.
After listening to the prosecution, Magistrate Kamanda accordingly discharged the accused persons and ordered that the matter should continue at the High Court. At the High Court, Detective Inspector Umaru Finney Kamara, attached to the Criminal Investigation Department headquarters, told the court that he executed three warrants of arrest for the accused persons on 28 August in respect of the offence of conspiracy to commit murder and murder, respectively.
The detective told the court he arrested all three accused on valid arrest warrants, which he tendered as exhibits A, B and C.
The judge noted that he was satisfied the names on the warrants marked on the exhibit were the names of the accused persons arrested on the said warrants and on the indictment.
He also ordered that the accused persons be served with their indictments through their respective counsels, Oladipo V. Robin-Mason and M.P. Sesay, within seven days.
The matter was adjourned to 17 September.
