Lawyer appeals for injunction to be lifted

Lawyer for plaintiff, New Black Down Shipping Company, has appealed to the presiding judge of the Fast Track Commercial Court to lift the seven days injunction he had slammed on his client as over 50,000 cartons of fish are languishing at the sea.
Augustine B. Samura said the matter was urgent and needed attention as large quantum of fish are perishing at sea due to the injunction, which has restrained his client from selling them out of the country, thus urging the court for consideration of the matter.
Lawyer for the defendant, Abdul K. Kamara, had filed for an ex-parte interim injunction which was granted by the court.
However, Mr. Samura argued that he only received the affidavit few minutes to the start of proceedings for the injunction, adding that he could not file a reply as a result, thus asking to be given time to respond.
Meanwhile, Judge Sengu M. Koroma said the court could help by selling the fish to prevent them from perishing. He however urged counsels to limit their legal argument to the boats, noting that the injunction would be extended for another seven days because a third party is now involved in the matter.
Judge Koroma advised that the two counsels consider to reach a consensus should the plaintiff be ready to accept.
He adjourned the matter to today 25 August.
